Unpaid electricity bills, what to do? Its fate was sanctioned by the TAR and the Council of State according to which the other users will be responsible for it. A decision that is already causing discussion.
According to what reported by the Sole24ore, there is a hole of about one billion euros in terms of electricity bills not paid by the defaulters. In their place, it will be the users who pay their consumption regularly to pay the costs.
This is an estimated figure as it is currently impossible to give an exact figure. So far, appeals and rulings of the TAR and the Council of State have decided that the so-called electrical “general charges” equal to about 200 million arrears will be distributed among all consumers.
A problem, that of arrears, which had brought some electricity companies to their knees, some of which were forced to close because they had found themselves in the red when paying the suppliers, not having been able to collect some parafiscal items of the bill.
But why should the expense fall on other users?
What is certain is that there are other resolutions still being studied to complete the procedures by which consumers will have to reimburse what has not been paid by the clever bills.
For its part, the Electricity Authority minimizes, specifying and
"The aforementioned provision (resolution 50/2018) concerns only a particular case series, limited in number, and only a part of the general system charges provided for by law. In particular, the recognition identified by the Authority for distributors only is partial and pertains to general system charges only already paid by them but not collected by those vendors with whom, in the face of the latter's default, the distributors interrupted the related energy transport contract, thus effectively suspending these subjects the possibility of operating in the energy market " .
According to the authorities, this would be a partial and circumscribed mechanism aimed at guaranteeing the revenue from the system charges to be insured by law.
“The judgments of the administrative justice maintain that the law imposes on the head exclusively to end customers, and not to the sales companies, nor to the recipients of the incentives, the general system costs, with the consequence that the Authority would not have the power to impose the aforementioned system of guarantees on the sales companies, denying that the risk of non-collection of general system charges on the part of end customers and sellers ".
In fact, the law has established that it is the users who are responsible for these expenses.
