Stop hunting in Puglia: the Council of State suspends the hunting calendar

It does not follow the guidelines for the protection of some endangered species and for this reason the hunting calendar in Puglia has been blocked until next 24 October. This was decided by the Council of State following the appeal presented by the “Verdi, environment and society” association, on which the TAR had already expressed itself, rejecting the appeal.

Pending the collegial hearing scheduled for the end of the month, hunting in Puglia is now suspended. According to environmentalists, in fact, the calendar is based on a hunting wildlife plan expired in 2014 and extended from year to year and would not comply with the technical-scientific opinion of Ispra.

Among the disputed issues are the pre-opening and post-opening periods of the hunt and the harvesting periods of some species considered protected. This is why the Council of State, on 4 October last, accepted the suspension of the provision issued by the regional administrative court on 20 September, "suspending the enforceability of the contested acts at first instance, up to the collegial discussion in the council chamber" , we read in the decree.

The alleged irregularities on the resolution of the regional council of last August 2, which establishes the start of the hunting season on September 15 and the end of January 29, 2020, with the possibility of bringing forward to September 1 and 4 for some species - are relating to failure to execute the opinion of the Higher Institute for Environmental Protection and Research. Compulsory opinion, but not binding by law, "to which the Region has not considered adapting, without however giving reasons for such failure to integrate receipt".

Opinion of Ispra that structures the hunting calendar in such a way as not to endanger the birds, following the time limits imposed for individual species by the European Commission. There are several species for which the recommendations have not been followed, such as pheasant, woodcock and wood pigeon. For the latter, for example, the Council resolution provides that the pre-opening period of the hunt is on 1 and 4 September, "but the Key Concepts, ie the time limits, require it to open only on XNUMX October", we read in the appeal.

Appeal that on 20 September the council chamber of the Puglia Tar has not accepted. Fifteen days later, the Administrative Court of Appeal overturns everything, asserting that "it is necessary to deepen at least in the collegial and contradictory precautionary seat, the adequacy profiles of the reasons on the basis of which the Puglia Region has deviated from significant critical findings of the opinion technical-scientific of Ispra ". Also recalling how the safeguarding of species must be the most important aspect to be protected: "the compromise of the fauna heritage, and therefore of the territorial biodiversity, appears as a prejudice - pending the decision - by its nature not restorable, since it is the destruction of human beings. living ".

The animal rights activists rejoice, therefore, a little less the hunters: the National Federcaccia, theEnalcaccia andArcicaccia they announce that they want each other immediately constitute in court.
