L'bear M49, 3 and a half years old and a great desire for freedom, had been captured a few hours ago by the staff of the Trentino Forestry Corps and taken to the Casteller wildlife area, in southern Trento. From here, in a short time, however, M49 managed to escape by climbing over the numerous fences, including electrified ones, and entering the woods.




    Now the order to be hangs on him shot on sight, supported, alas, by the decision of the Constitutional Court to declare legitimate the laws of Trento and Bolzano on the capture and eventual killing of bears and wolves.

    A provision that comes after the examination in the council chamber of the two appeals of the Prime Minister towards the two autonomous Provinces.

    What happened

    The bear M49, "with problematic behavior" - as stated in a note from the Province of Trento, in recent weeks would have damaged numerous farms and pastures in the Brenta area. It was thus captured in the mountains of the val di San Valentino, adopting "the best protocols available to limit the risks for the animal during the capture phases" and transported to the Casteller wildlife area, within which it was released. without sedating him and without a radio collar.

    However, M49 managed to escape almost immediately, overcoming the electric containment fences (14 wires in total) and exiting the fence.

    “It also passed two further internal electric fences that separated it from the DJ3 bear, another specimen that has long been kept in the wildlife area. To give an idea of ​​the overall safety of the structure, consider that the electrified fences present in the Casteller enclosure have a range from 6 to 8000 volts ".

    The decision of the Constitutional Court

    The Consult stated the question of constitutional legitimacy is unfounded, judging that "the contested provincial discipline falls within the scope of the legislative powers entrusted to the two autonomous provinces".

    In essence, the Constitutional Court makes it known in a note that "the question of constitutional legitimacy is not well founded, judging that the contested provincial discipline falls within the scope of the legislative powers entrusted to the two autonomous provinces.



    Therefore, the provincial laws of Trento (n.9 / 2018) and Bolzano (n.11 / 2018) which authorize the President of the Province to adopt measures concerning the taking, capture and eventual killing of bears and wolves, are legitimate, when the conditions envisaged by the European-derived legislation on the conservation of natural habitats are met. This power is aimed at preventing serious damage to crops, livestock and guaranteeing public safety, when there is no other valid solution, and is subject to the prior opinion of ISPRA ".

    The "bear hunt" therefore continues and, we must understand, if no one finds an "other valid solution", M49 is doomed.

    Already in 2012 and 2014, with the case of the bear Daniza, incorrect doses of anesthetic used in the capture phase - and the failure to administer oxygen or drugs antagonists to metedomidine to prevent her from dying - had led to the killing of innocent animals. , raising a big debate among public opinion. Now the step seems longer, with the order to kill an animal that in any case would not have attacked any human being.

    However, we remain hopeful in the good intent of Minister Costa who yesterday declared that he had "asked Ispra to immediately send a team of experts who, together with the technicians of the autonomous province of Trento, clarify the escape of M49 and then intervene with the caution of the chance, without undermining the life of the animal ".

    In short, there must be an alternative solution to killing.

    The opinion of the WWF

    According to the WWF, the Council's ruling concerns a problem of regulatory competences between the State and autonomous Provinces and not concrete cases. The association states in a statement:


    "It should also be noted that the decision of the Constitutional Court has nothing to do with the current story of the Bear M49: the urgent order signed by the President of the Province of Trento for the 'removal' of the bear considered dangerous without any concrete and demonstrable motivation is illegitimate, so much so that the Ministry of the Environment has warned the province of Trento to kill the animal that is guilty of having stolen some food. If anything, today's decision by the Judge of Laws reinforces what has always been argued by WWF and other associations: the need for collaboration by regions and autonomous provinces with the competent technical-scientific bodies of the State to guarantee ever better protection of these magnificent animals. , together with that of human safety (which in reality is not at all threatened by bears and wolves if a few simple rules of behavior are adopted) ".
