This is the first case of application of a reform of the Spanish Civil Code which recognizes pets as "sentient beings", ie as "beings endowed with sensitivity"

In Spain the law that officially recognizes animals as beings endowed with sensitivity, able to feel pain and no longer as objects, came into force just three weeks ago, and now it already has its first application. Tuco, a mix between a Belgian Shepherd and a Pitbull, becomes the first animal that for justice is seen as just being sentient.

Five and a half years of fur, Tuco lives in the city of Oviedo, Asturias, and he has been granted the right to remain in foster care with the person who has taken care of him since his declared owner moved abroad, in 2018.

It all started with a petition launched by Oumaima Laamar, the young woman who began to take care of him and with whom he established an important emotional bond.

Right now I'm going through the worst period of my life, they want to take me away from my dog and nobody does anything, I really need help…, he wrote, telling his story and that of Tuco.

It was 2018 when the owner of Tuco left for an Erasmus project in Mexico. At that point, Oumaima began to take care of him, establishing a strong bond. Then back in December 2020, the boy wrote a message to Oumaima: "I'm back, I'm bored, leave me the dog". But the girl is not there and in February 2021 they end up in court: he denounces her for embezzlement. You submit bills for food and veterinary expenses to the judges.

Tuco had been registered in the boy's name in June 2016 in the Community of Madrid pet registry, but Oumaima filed a similar document made by her in 2019 in Asturias.

A diatribe which only this new law has put an end to. Justice has run its course and has taken into account only one thing: the serenity of that dog.
