    Photovoltaic incentives: the new tariffs and criteria of the 2011 Energy Account have been formalized

    The Energy Account 2011, finally, is law, following the publication of the decree n. 6/2010 (containing measures to encourage the production of electricity through photovoltaic conversion from solar sources) in the Official Gazette. The new tariffs will apply to photovoltaic systems that will come into operation after 31 December 2010, not only in the case of newly built systems, but also in the case of a total refurbishment of existing systems or their upgrading. Therefore, they will not apply in the case of minor interventions on plants already in operation.

    Finally, the 2011 Energy Account is law, following the publication of decree no. 6/2010 (containing measures "to encourage the production of electricity through photovoltaic conversion from solar sources) in Official Gazette. The new rates will apply to photovoltaic systems which will come into operation after December 31 2010, not only in the case of newly built plants, but also in the case of a total refurbishment of impianti existing or strengthening of the same. Therefore, they will not apply in the case of minor interventions on plants already in operation.

    A criterion has also been set for establish precedence in the event that the funds are not enough: in case of exhaustion of availability, in fact, they will be entitled to incentive rates for plants that come into operation within fourteen months (expandable to 24 months for plants whose responsible parties are public bodies) from the dates identified and disclosed by the implementing body on its website, in which the availability limits will be reached. Confirmed the national target of cumulative installed photovoltaic nominal power, from today to 2020, of 8 thousand MW, it has been established that it will be possible to produce electricity with photovoltaic systems for a total amount of 3 mila Megawatt. Among them, photovoltaic systems with innovative technological features will be able to take advantage of the incentive rates up to a cumulative production of 300 MW while for concentrated photovoltaic systems the threshold of electricity production that can be incentivized is set at 200 MW.

    In addition, to take advantage of the incentives, the person in charge of the photovoltaic system must send to the implementing body, within ninety days from the date of entry into operation, the application for the concession of the relevant incentive rate. This is a right that can lapse if the photovoltaic system should be moved to a different place from that of first installation. Any changes to the system configuration on the same site cannot lead to an increase in the incentive rate.



    La sale of the photovoltaic system, or the building or real estate unit on which it is located together with the plant itself, must be communicated to the implementing body within 30 days from the date of registration of the deed of sale. The period of entitlement to the incentive tariffs is considered net of any stops arranged following problems connected with network security or following disasters recognized as such by the competent authorities.
