    The hearing of the pesticide trial against Karl Bär, a collaborator of the Umweltinstitut München (currently on leave for his election to the German Bundestag), who should have appeared for the fourth time before the Court of Bolzano for having moved hard criticism of the use of pesticides in the apple orchards of Alto Adige / Südtirol.

    On the other hand, on 28 May the Austrian author and director Alexander Schiebel, also accused of aggravated defamation of South Tyrolean agriculture, was acquitted because, according to the sentence, the "South Tyrolean fruit growers" were not clearly identifiable and therefore could not be indicted. Therefore no crime had been committed. And now, according to the defense attorney, this same argument could also be applied to the case of Karl Bär.

    What had happened

    It all started in 2017, when the Umweltinstitut München, the Munich Institute for the Environment, carried out an information campaign entitled "Pestizidtirol" to raise public awareness on the widespread use of pesticides in South Tyrol and exhibited for a few days a denouncement poster in the Munich subway stop at Karlsplatz.

    The spokesperson for the campaign was Karl Bär, then head of agricultural and commercial policies at the Bavarian Institute. Also in that year, the author Alexander Schiebel published the book Das Wunder von Mals (The Miracle of Malles), the town of Alto Adige / Südtirol which in 2014 held a referendum to ban a series of pesticides.

    The criticisms of the ecologists - explains the lawyer - if they are based on the truth of the facts, they are not a crime as the court of Bolzano has already repeatedly ascertained: this is why we expect all the farmers to immediately withdraw the reckless complaints.


    At the start of the pesticide trial in September 2020, there were 1376 defamation complaints against Karl Bär.

    Today was the fourth day of the trial in the pesticide trial against me in South Tyrol. Nothing happened again. It continues on January 28th. Then the last person to volunteer in the process is brought in by the police to testify. This is more than an absurd farce: it is abuse of justice.

    The postponement

    At the fourth hearing in Bolzano, farmer Tobias Gritsch, the last plaintiff left in the proceedings, did not appear in court and the judge thus ordered his compulsory accompaniment for the next hearing, scheduled for January 28, 2022. 

    It is difficult to think that there could be anything more absurd than what is happening here in South Tyrol / Südtirol. Bar.

    In fact, following a trial already underway for over a year and after four hearings, no element has yet emerged that really has to do with the alleged crime.
