Garden bonus 2022: who is entitled to and how does the concession for green areas and terraces work

The green bonus for gardens and terraces has also been confirmed for 2022. Let's see what it consists of and who can get it

Among the numerous confirmed tax breaks there is also the green bonus, better known as a garden bonus. This is a 36% personal income tax deduction on expenses incurred for various types of work in the green areas of buildings and real estate units. Its duration has been extended until 2024 by the 2022 Budget Law. Let's see in detail how it works and who can use it.

Green bonus: expenses covered by the subsidy

As anticipated, the green bonus consists of one 36% personal income tax deduction on the expenses incurred for this series of interventions:

  • green arrangement of private uncovered areas of existing buildings, real estate units, appurtenances or fences
  • irrigation systems and well construction
  • construction of green roofs and hanging gardens

In addition, expenses incurred for interventions carried out on the external common parts of condominium buildings are also eligible, up to a maximum total amount of 5.000 euros per residential unit.

As clarified on the Revenue Agency website, "in this case the individual condominium has the right to deduct within the limit of the amount attributable to him provided that the same has actually been paid to the condominium within the terms of presentation of the tax return."

The deduction is not due, however, for expenses incurred in these cases:

  • the periodic ordinary maintenance of pre-existing gardens not connected to an innovative or modifying intervention in the terms indicated above
  • jobs in economics

The deduction must be divided into ten annual installments of equal amount and must be calculated on a maximum amount of 5.000 euros per housing unit. This means that the maximum deduction is 1.800 euros (36% of 5.000) per property.

Green bonus: who can request it

But who can take advantage of this bonus? All taxpayers who own or hold, on the basis of a suitable title, the property on which the interventions are carried out and who have incurred the related expenses are entitled to the benefit.

In addition to the owners, the deduction is also due to the naked owners, holders of a real right of enjoyment on the property subject to intervention (for example), tenants or borrowers.

Payment methods accepted for obtaining the bonus

Finally, it is essential that the taxpayer interested in accessing the deduction uses traceable payment methods for all those expenses incurred for the interventions provided for by the facility.

Therefore, those who want to take advantage of the tax deduction must pay the expenses with the following traceable methods:

  • credit cards
  • cash machine
  • bank or postal transfer
  • non-transferable checks

It should be clarified that no discount is recognized at the time of payment. The amount of eligible expenses will be fully paid by the taxpayer who must keep any invoices and produce the necessary documentation for the tax return in order to obtain a deduction of 36%.
