His anonymity, that aura of mystery that has always surrounded him (and that perhaps makes him love him even more), this time has pulled a bad joke on Banksy. The most famous street artist in the world has not seen the trademark recognized for one of his best known works, the Flower Thrower.

This was established by Euipo, the European Union for Intellectual Property. In the course of a lawsuit between Bansky and the manufacturer of greeting cards Full Color Black, EUipo has established that it cannot recognize the copyright for the famous graffiti 'The flower thrower' to the street artist because of its anonymity it does not allow us to identify the painter as a certain author.

A decision that is causing a lot of discussion if you think that one of Bansky's most famous creations, made in 2005 on a wall in Jerusalem, is involved in the decision. It portrays a man, a protester with his face partially covered as he is about to throw a bouquet of flowers instead of a stone.

Banksy had filed the trademark for the image in 2014 with the European Union but in 2018 Full Color Black, which wanted to use the image for its products, challenged this decision, arguing that the artist had filed the trademark without having the 'intention to use it for commercial purposes.

"It is clear that when Banksy filed the trademark, he had no intention of using the work to market goods or provide services," EUipo said, according to Ansa.

His anonymity therefore in this case proved to be a double-edged sword since it did not allow Euipo to

“Establish beyond any doubt that the artist has the copyright on graffiti”.
